These plans were unveiled at the homeowners association meetings on January 15 and April 16, 2019. Licciardello also claims homeowners were shown a map that included a fence and many residents were verbally informed that a fence was imminent.
Licciardello said, “The commitment, which is now over three years old, was to install a 6 to 7 foot high vinyl fence and plant tall trees on both Plantation Road and Shady Road to effectively protect our community very busy and high traffic community protect trafficking area. “
After the housing construction was completed and the fence was not built, some residents filed a complaint with the Sussex County Planning and Zoning Bureau. A violation was reported to the contractor, but it was later lifted.
According to Jamie Whitehouse, Sussex County’s Director of Planning and Zoning, the approved site plan referred to a fence, but the actual site plan drawing did not show a fence. Instead, a rainwater swallow was shown on the map.
He said it was understandable that there would be confusion as the representation of swallows and fences on the site maps was similar.
“The legend on the map referred to a proposed fence,” said Whitehouse. “That prompted further investigations with the [builder’s] Engineer and the Sussex Conservation District. “
He said when the county site plan drawing was compared to their drawings, it was found that a fence was not included in the final site plan and notification of violations was withdrawn on July 7.
Residents then submitted a revised site plan to the Sussex County’s Planning and Zoning Commission that included a fence at the intersection.
At its September 10 meeting, the P&Z commission postponed a vote on a proposed revision of the homeowners’ site plan for a 7-foot fence around the perimeter of the six units closest to the intersection, Whitehouse said. Letters were submitted in support of the application from 20 homeowners, or approximately 38 percent of the units under development.
The commission asked residents to get the entire homeowners association to vote on the revised site plan and submit the results to the commission.
“The planning and zoning commission did not close the door to a possible fence. It’s waiting for more information, ”said Whitehouse.
Licciardello said the builder, not the homeowners association, should pay to build the fence.
He said it was ironic that a large privacy screen had been put up on two sides of the new Sunset Glen parish, another Ryan Homes development just across from Somerset Green.
“It has become a private matter between the residents and the developer. The county is not involved in whether or not a fence is promised, ”Whitehouse said.
Calls to a representative from Ryan Homes were not answered.
